License Agreement

THE ULTIMATE ROULETTE SYSTEM LICENSE

THIS DOCUMENT IS VALUABLE PROPERTY. IT IS YOUR PROOF OF LICENSE FOR THE ULTIMATE ROULETTE SYSTEM SOFTWARE PRODUCT YOU HAVE ACQUIRED AND YOU MUST RETAIN THIS SOFTWARE LICENSE TO EXERCISE YOUR RIGHTS TO USE THE SOFTWARE.

This is a legal and nonexclusive agreement between you, the User (an individual only), and SAMUEL BLANKSON concerning your rights to use the SAMUEL BLANKSON software product ULTIMATE ROULETTE SYSTEM (URS), SUPER ULTIMATE ROULETTE SYSTEM (SUPER URS), ULTRA ULTIMATE ROULETTE SYSTEM (ULTRA URS), MASTERCLASS ULTIMATE ROULETTE SYSTEM (MASTERCLASS URS), POWER ULTIMATE ROULETTE SYSTEM (POWER URS), MULTIPLAY ULTIMATE ROULETTE SYSTEM ALPHA (MULTIPLAY URS ALPHA) AND MULTIPLAY ULTIMATE ROULETTE SYSTEM (MULTIPLAY URS OMEGA). Carefully read all the terms and conditions of this License Agreement ('License') before using the software. Usage of the software indicates your acceptance of all the terms and conditions of this License.

0. Wherever ULTIMATE ROULETTE SYSTEM is used in this License Agreement it shall represent any and all of the ULTIMATE ROULETTE SYSTEM product range. These include, ULTIMATE ROULETTE SYSTEM (URS), SUPER ULTIMATE ROULETTE SYSTEM (SUPER URS), ULTRA ULTIMATE ROULETTE SYSTEM (ULTRA URS), MASTERCLASS ULTIMATE ROULETTE SYSTEM (MASTERCLASS URS), POWER ULTIMATE ROULETTE SYSTEM (POWER URS), MULTIPLAY ULTIMATE ROULETTE SYSTEM ALPHA (MULTIPLAY URS ALPHA) AND MULTIPLAY ULTIMATE ROULETTE SYSTEM OMEGA (MULTIPLAY URS OMEGA).

1. TERMS OF LICENSE

ULTIMATE ROULETTE SYSTEM or any portions thereof shall be used by the User only, on a personal computer.

2. APPLICATION AND USE

ULTIMATE ROULETTE SYSTEM shall be used only for gambling with the User’s own personal funds. The User shall not use ULTIMATE ROULETTE SYSTEM in any other manner which would permit or allow the use of ULTIMATE ROULETTE SYSTEM or any portion thereof in connection with transactions in which the Users own personal funds are not involved. The User shall under no circumstances assign to any other person ULTIMATE ROULETTE SYSTEM and any willful attempt to do so shall entitle SAMUEL BLANKSON to consider it as a material breach of this agreement.

3. COPYRIGHT

The ULTIMATE ROULETTE SYSTEM software is owned by the SAMUEL BLANKSON and/or SAMUEL BLANKSON’s licensors who shall retain all and sole rights, title and interest in, and to the software. By virtue of this License you obtain the right to use the Software only. The software is protected by the United Kingdom and United States Copyright Law and international treaty provisions. You agree not to remove any copyright or other proprietary or product identification notices from the Software.

4. TERMINATION

This License is effective from the date you receive the Software, and shall remain in force, unless terminated in writing by the User or SAMUEL BLANKSON. The License shall also be terminated if you fail to comply with any of the terms and conditions in this License. You agree, upon any such termination, to destroy the Software together with all copies, modifications, and merged portions in any form.

5. LIMITED WARRANTY

SAMUEL BLANKSON warrants that the Software will perform substantially in accordance with the User usage guide for a period of ninety (90) days from the date of installation. Any implied warranties that may be applicable to the Software are strictly limited to such ninety (90) day period. In the event of a failure to so perform that is not caused by accident, abuse or misapplication that is made known to SAMUEL BLANKSON within the said 90-day period, SAMUEL BLANKSON’s sole obligation (and your sole and exclusive remedy) will be at SAMUEL BLANKSON's option to either repair the defect or replace the defective product. SAMUEL BLANKSON's obligation hereunder will be limited to such repair or replacement. Except as stated in the immediate paragraph above, SAMUEL BLANKSON disclaims any and all warranties, either express or implied, including, but not limited to the implied warranties of merchantability and fitness for a particular purpose.

6. LIMIT OF LIABILITY

In no event shall SAMUEL BLANKSON be liable for any damages including any lost profits, lost savings or other indirect, incidental, special or consequential damages arising out of the use or inability to use such software even if SAMUEL BLANKSON has been advised of the possibility of such damages, or for any claim by any other party. SAMUEL BLANKSON's liability for damages hereunder shall in no event exceed the amount paid for the software under the terms and conditions of this agreement.

7. SUPPORT

In addition to the licensing of ULTIMATE ROULETTE SYSTEM, as provided herein, SAMUEL BLANKSON will provide the co-operation and support necessary to successfully implement and use ULTIMATE ROULETTE SYSTEM on the user’s equipment and perform troubleshooting. This will be free of charge for a period of ninety (90) days from the date of original purchase. Past this period, all labor and transport charges will be for the account of the user.

8. SOFTWARE UPGRADES AND UPDATES

SAMUEL BLANKSON shall provide the User with all available software updates and or upgrades as soon as they become available free of charge for a period of 12 months from the date of original installation. 

9. MAINTENANCE

On expiration of the first 12 months after the date of original installation, and every 12 months thereafter, a maintenance charge at the yearly rate of 10% of the original and total price paid for the software will be charged by SAMUEL BLANKSON to User automatically, unless specified otherwise in writing by User. This maintenance charge will cover free upgrades and/or updates of the ULTIMATE ROULETTE SYSTEM software ONLY.

10. OTHER PROVISIONS

The User may not use, copy, modify, sublicense, assign, rent, lease or transfer this license or the Software, except as expressly provided in this Agreement. The User acknowledges to have read this Agreement, understand it, and agree to be bound by its terms and conditions. The User agrees to use the Software in machine-readable form only and agrees not to cause or permit reverse compilation or disassembly of the Software.

11. USER OBLIGATIONS

The User shall provide SAMUEL BLANKSON with all the files required to maintain and support the ULTIMATE ROULETTE SYSTEM software. Such files will include, but not be limited to, hardware specification, statement document of previous play sessions, assistance of the User whenever required, and provision of additional information where appropriate.

12. APPLICABLE LAW

This Agreement shall be governed by, and construed in accordance with the laws of the United Kingdom.
